General Terms and Conditions

Ownership of Rights

All rights, including copyright, in this website are owned by or licensed to Mossfraser. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Mossfraser. You may not modify, distribute or re-post anything on this website for any purpose.

Payment to Mossfraser

We won't ask you for any payment until the final stage of the order process following the successful entry of your payment details on a secure server. Payment for the goods and delivery charges can be made by any method shown on the mossfraser.com website at the time you place your order.

Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle mossfraser to terminate the contract immediately.

There will be no delivery until cleared funds are received. Payment shall be made by you without any deduction whatsoever unless you have a valid court order requiring an amount equal to such deduction to be paid by mossfraser to you.

When you are ready to place you order, you will be transfered to our payment service provider 'Secure Trading'  which is a secure environment where you can enter your credit or debit cards. We do not collect or store your credit card details ourselves.

All prices include VAT.

Accuracy of Content

Mossfraser has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only.

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

To the extent permitted by applicable law, Mossfraser disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Mossfraser shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Damage to Your Computer

Mossfraser makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Mossfraser shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

Ordering Errors

You are able to correct errors on your order up to the point at which you click on 'submit' on the final page of our ordering process.

Acknowledgment and Acceptance of Your Order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details. Our acceptance of your order will take place upon despatch of the product(s) ordered.

Cancellation Right

Under the distance selling regulations you have the legal right to cancel your order within 14 days of receipt of the goods (with the exception made to order products). Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered.

We may have placed links on this website to other websites we think you may want to visit. We do not vet these websites and do not have any control over their contents. Mossfraser cannot accept any liability in respect of the use of these websites.

Exclusions of Liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Mossfraser or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
